Garanzia limitata e legale

Last Modified: June 2, 2026

Legal Guarantee of Conformity (Articles 128-135 of the Consumer Code):
As a professional seller, we are legally responsible for any lack of conformity existing at the time of delivery of the goods and which becomes apparent within two years of delivery [15†L8-L10][18†L20-L21]. For used goods, this period may be reduced to one year. For contracts concluded after June 19, 2026, Directive (EU) 2023/2673 may require an update to the terms [10†L17-L19].

Consumer's Obligations to Enforce the Warranty:

  • Report the defect to the Seller within two months from the date of its discovery.

  • Keep proof of purchase (confirmation email, receipt).

  • Provide a detailed description of the defect and, if possible, photographic evidence.

Presumption of Pre-existence of the Defect:
For defects that become apparent within 12 months of delivery (20 months for contracts concluded up to June 19, 2026, and up to 24 months for new contracts), it is presumed that the defect already existed at the time of delivery. In such a case, it is up to the Seller to prove otherwise [18†L30-L31][19†L30-L36].

Remedies Available to the Consumer:
In case of a lack of conformity, the Consumer is entitled, in order of preference:

  1. Free repair or replacement of the goods, unless the requested remedy is objectively impossible or excessively burdensome compared to the other.

  2. Price reduction or termination of the contract (with consequent refund), if repair and replacement are impossible, excessively burdensome, have not been carried out within a reasonable time, or have caused significant inconvenience to the Consumer.

The legal guarantee applies independently of any commercial warranty offered.

Limited Commercial Warranty (Voluntary):
The Seller may offer an additional commercial warranty for some products. In such a case, the conditions (duration, scope, activation methods) will be clearly indicated in the product sheet and in the documents delivered to the Consumer. The commercial warranty does not replace or limit the legal warranty.
